4 types of “attractive nuisance” hazards

Some features on a property can appear inviting to children while posing serious dangers. These are known as attractive nuisances. Property owners may be held responsible if a child is injured by one of these hazards, even if the child entered without permission.

The attractive nuisance principle exists because young children are not expected to understand risks the same way adults do. When dangerous objects or conditions are left accessible and unguarded, serious injuries may result, including those from slip and fall incidents.

1. Swimming pools and fountains

Children are naturally drawn to water, and an unfenced or unsecured swimming pool or decorative fountain can be a major hazard. Slippery surfaces surrounding pools can lead to falls, especially if children are running or climbing. Even shallow water can pose a risk of drowning or injury.

2. Abandoned appliances or equipment

Discarded refrigerators, washers, and other large equipment left in accessible areas can attract children looking for a hiding place or adventure. These items may tip, trap or injure a child who tries to climb inside or on top of them. If they are not removed or secured, the risk of injury is significant.

3. Unsecured ladders and scaffolding

Ladders leaning against a structure or scaffolding left up after a repair project may seem like a fun climb to a child. However, these can quickly lead to falls from height, especially when the surface is unstable or the child lacks balance or supervision.

4. Play structures in disrepair

Treehouses, swing sets or other backyard play structures that are damaged or poorly maintained can also be hazardous. Loose boards, exposed nails or rotting materials may result in injuries such as cuts, falls or broken bones. If a child accesses such a structure and gets hurt, the condition of the equipment may become the key issue.

Slip and fall accidents are one possible outcome of these hazards, and they are often preventable with proper upkeep and secure boundaries. If someone has been injured due to one of these conditions, a review of the property’s safety measures may be important to determine what went wrong.
